1. Acceptance of Terms

By accessing or using the EleFence website (https://elefence.com), submitting a lead form, requesting an estimate, or engaging our services, you agree to be bound by these Terms and Conditions ("Terms"). If you do not agree, please do not use our website or services.

2. Services

EleFence provides residential and commercial fencing services in the Austin, Texas metropolitan area and surrounding communities, including but not limited to:

• Cedar privacy fence installation
• Wrought iron and ornamental iron fence installation
• Board on board fence installation
• Ranch rail and agricultural fencing
• Fence repair and replacement
• Gate installation and automation
• Fence staining and sealing

Specific services, materials, pricing, and timelines are subject to the terms of individual written estimates or contracts provided to you.

3. Estimates and Pricing

Estimates provided by EleFence are based on information available at the time of assessment, including visual inspection, satellite imagery, and details you provide. Estimates are valid for 30 days from the date issued unless otherwise stated.

Actual project costs may differ from estimates due to unforeseen site conditions, including but not limited to: underground utilities, rock, roots, grade changes, soil conditions (including Austin-area clay and limestone), easements, survey discrepancies, or HOA requirements discovered after the estimate is provided.

EleFence reserves the right to adjust pricing if material costs change significantly between the date of estimate and the date of installation.

4. Property and Site Conditions

By engaging our services, you represent and warrant that:

• You are the property owner or have authorization from the property owner to install fencing
• You have obtained or will obtain any required HOA approvals prior to installation
• You are responsible for identifying property boundaries and providing a current survey if requested
• You will disclose known underground utilities, irrigation lines, septic systems, or other subsurface conditions
• You will provide reasonable access to the work area on the scheduled installation date(s)

EleFence is not responsible for damage to unmarked underground utilities, irrigation systems, or other subsurface structures. We recommend calling 811 (Texas One-Call) prior to any installation.

5. Payment Terms

Payment terms will be specified in your individual estimate or contract. Unless otherwise agreed in writing:

• A deposit may be required prior to scheduling installation
• Final payment is due upon completion of installation
• Accepted payment methods will be communicated at the time of booking

Late payments may be subject to a fee of 1.5% per month or the maximum rate permitted by Texas law, whichever is less.

6. Scheduling and Cancellation

Installation dates are scheduled based on material availability, crew availability, and weather conditions. EleFence will make reasonable efforts to meet scheduled dates but is not liable for delays caused by weather, material supply chain disruptions, permit delays, or other circumstances beyond our control.

If you need to cancel or reschedule, please provide at least 48 hours' notice. Deposits may be non-refundable if cancellation occurs after materials have been ordered or cut.

7. Warranty

EleFence provides a workmanship warranty as specified in your individual contract or estimate. This warranty covers defects in installation and labor. It does not cover:

• Normal wear and tear, weathering, or natural aging of materials
• Damage caused by storms, floods, wind, falling trees, or other acts of nature
• Damage caused by third parties, animals, vehicles, or improper use
• Changes to grade, drainage, or landscaping that affect the fence after installation
• Natural characteristics of wood such as warping, splitting, shrinking, or color variation

Material warranties are provided by the respective manufacturers and are separate from our workmanship warranty.

8. Limitation of Liability

To the maximum extent permitted by Texas law, EleFence's total liability for any claim arising from our services shall not exceed the amount you paid for the specific service giving rise to the claim. EleFence shall not be liable for any indirect, incidental, consequential, or punitive damages.

9. SMS/Text Message Terms

By providing your mobile phone number on any EleFence form, you consent to receive text messages (SMS/MMS) from EleFence. These messages may include:

• Responses to your inquiry or estimate request
• Appointment confirmations and reminders
• Project updates and scheduling notifications
• Follow-up communications related to your fencing project

Message frequency varies. Message and data rates may apply. You may opt out at any time by replying STOP to any message you receive from us. For help, reply HELP or contact us at the information provided in Section 17.

Consent to receive text messages is not a condition of purchasing any goods or services from EleFence.

No mobile information will be shared with third parties or affiliates for marketing or promotional purposes. All of the above categories exclude text messaging originator opt-in data and consent; this information will not be shared with any third parties. Carriers are not liable for delayed or undelivered messages.

10. Intellectual Property

All content on the EleFence website, including text, images, graphics, logos, and design, is the property of EleFence or its licensors and is protected by applicable intellectual property laws. You may not reproduce, distribute, or create derivative works from our content without our prior written consent.

11. Website Use

You agree to use our website only for lawful purposes and in a manner that does not infringe upon or restrict the rights of others. You may not:

• Use automated tools to scrape, crawl, or collect data from our website
• Attempt to gain unauthorized access to our systems or servers
• Submit false, misleading, or fraudulent information through our forms
• Use the website in any way that could damage, disable, or impair its operation

12. Third-Party Links

Our website may contain links to third-party websites or services. We are not responsible for the content, privacy practices, or terms of any third-party sites. Your use of third-party sites is at your own risk.

13. Indemnification

You agree to indemnify and hold harmless EleFence, its owners, officers, employees, and agents from any claims, damages, losses, liabilities, and expenses (including reasonable attorney fees) arising from your use of our website or services, your breach of these Terms, or your violation of any law or the rights of a third party.

14. Governing Law and Dispute Resolution

These Terms are governed by the laws of the State of Texas. Any dispute arising from or relating to these Terms or our services shall be resolved in the state or federal courts located in Travis County, Texas. You consent to the personal jurisdiction of such courts.

15. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be modified to the minimum extent necessary to make it enforceable, and the remaining provisions shall continue in full force and effect.

16. Changes to These Terms

We may update these Terms from time to time. The updated version will be indicated by the "Effective Date" at the top of this page. Continued use of our website or services after changes constitutes acceptance of the revised Terms.
